- PUBLIC COMMENT
Chairman McKinstry informed all present that Public Comment is the time to offer comments on any agenda item not on the agenda and to bring any issues/concerns before the Board.
Shelly Mincer thanked the Public Works Department and the Po-Mar-Lin fire department for their response and efforts. Ms. Mincer stated that the Unionville-Chadds Ford School District property should not be allowed to obtain a demolition permit to remove the barn, located along East Doe Run Road.
Ruthie Kranz-Carl would like the Board to support the Chester Water Authority by opposing the sale of the Authority to Aqua America, Inc. by the City of Chester, Delaware County, PA.
John Auger stated he is will be submitting his application in for the supervisor vacancy.
- ANNOUNCEMENTS
Chairman McKinstry stated the Willowdale Steeplechase and the Kennett Run have been
canceled.
- NEW BUSINESS
- Acceptance of Resignation – Supervisor Julia Lacy
Supervisor Monahan initiated and the other supervisors followed suit expressing their
appreciation for Supervisor Lacy’s service and expertise that she provided to the Board.
A motion was made by Chairman McKinstry, seconded by Supervisor Monahan, and
carried by a vote of 4-0, to accept the resignation or Julia Lacy from the Board of Supervisors effective Monday, May 4, 2020.

- Contract Award for Route 82 UCFSD Crosswalks Improvements funded through the 2018 Transportation Alternatives grant program
A motion was made by Supervisor Monahan, seconded by Vice-Chairman Sarro, and
carried by a vote of 4-0, to award the contract for the Route 82 UCFSD Crosswalks Improvements to RoadCon, Inc., as the lowest responsible bidder, in the amount of $827,148.00
- Unionville-Chadds Ford School District – Proposed Outdoor Facility Enhancements
Cathy Lee, P.E. Applicant’s Engineer and James Whitesel, UCFSD Supervisor of
Buildings & Grounds were present. Cuyler Walker, Chair of the Township’s Planning Commission was also present.
Discussion focused on the proposed trail that interconnects the playing fields, parking lot, and other school grounds. Further conversation focused on the material for the proposed trail, whether it should be macadam or woodchips. It was agreed by the Board of Supervisors and the Applicant’s representatives that a continuous landscaped buffer was not necessary along East Doe Run Road.
- Chester Water Authority – Discussion of Potential Sale to Aqua, America, Inc.
Chairman McKinstry summarized his key points in drafting the proposed resolution
that is before the Board of Supervisors this evening.
A motion was made by Chairman McKinstry, seconded by Vice-Chairman Sarro, and
carried by a vote of 4-0, to adopt Resolution No. 2020-24 that urges, in the strongest possible terms, that Governor Wolf and the Pennsylvania Department of Community and Economic Development immediately and publicly commit to Chester Water Authority’s continued existence as an independent municipal water authority, to protect public access to the Octorara Reservoir, and to advocate for the best interest of over 200,000 Chester Water Authority ratepayers.
- ORDINANCE 2020-03: CREATING THE OFFICE OF TOWNSHIP MANAGER
- Public Hearing to Consider Ordinance No. 2020-03
Chairman McKinstry stated that the proposed ordinance was advertised in the April 27,
2020 edition of the Daily Local News as required, as well as posted on the Township website.

A motion was made by Supervisor Monahan, seconded by Vice-Chairman Sarro, and
carried by a vote of 4-0, to adopt Ordinance No. 2020-03, creating the Office of the Township Manager and providing the manager of filling said office, the amount of bond, method of compensating such officer and the power and duties of the Office.
- Resolution 2020-21 – Signing Authority for Unionville Post Office Lease Renewal
Chairman McKinstry reviewed the efforts that he and Theo Claypoole, Esq., Township
Solicitor undertook to get the proposed lease as it is presented tonight to completion.
A motion was made by Chairman McKinstry, seconded by Vice-Chairman Sarro, and
carried by a vote of 4-0, to adopt Resolution No. 2020-21, authorizing the Township Manager to execute and deliver a lease to the United States Postal Service for the Unionville Post Office, located at 1752 W. Doe Run Road, Unionville, Pennsylvania, which is owned by East Marlborough Township.
- Resolution 2020-22 – Request for a sewage facilities program grant to be used for ACT 537 plan update preparation
Jeff Simpson, Public Works Director, stated the last time the Township’s Act 537 Plan
was updated was in 2007. Mr. Simpson stated that the total projected costs is $152,573.00 and the grant requires a 50% match which the Township would be responsible for $76,286.00.
A motion was made by Chairman McKinstry, seconded by Supervisor Monahan, and
carried by a vote of 4-0, to adopt Resolution No. 2020-22, authorizing the Township Manager as the official to execute all documents and agreements between the Township of East Marlborough and the Commonwealth Financing Authority to facilitate and assist in obtaining the requested grant.
- Resolution 2020-23 – Extension of FACE VALUE PERIOD FOR 2020 REAL ESTATE TAXES
Township Manager Lovekin stated the resolution before the Board of Supervisors
proposes to extend of the face value for 2020 Real Estate Taxes to the end of calendar year. This resolution is due to the COVID-19 hardships effecting township residents.
A motion was made by Supervisor Monahan, seconded by Supervisor Matuszak, and

carried by a vote of 4-0, to adopt Resolution No. 2020-23, (1) collect the real property tax at the Township of East Marlborough’s prescribed discount rate through May 31, 2020; and (2) waive any fee or penalty otherwise associated with the late payment of the real property tax if paid in
full by December 31, 2020. This Resolution shall apply only to real property taxes for calendar year 2020.
- CONTINUING BUSINESS
- Escrow Release for Northridge #7 development. (Phases 1a. and 2b.)
Engineer Donlon stated she received a request from Northridge for a release of
escrow funds in the amount of $99,994.19. After inspections, the release was recommended by Engineer Donlon.
A motion was made by Supervisor Monahan, seconded by Vice-Chairman Sarro, and
carried by a vote of 4-0, to authorize release of escrow No. 7 for Northridge Development (Phases 1a and 1b) in the amount of $99,994.19, as recommended in the VanDemark & Lynch, Inc. letter dated, April 23, 2020.
- APPROVAL OF MINUTES
A motion was made by Supervisor Monahan, seconded by Vice-Chairman Sarro, and carried by a vote of 4-0, to approve the minutes of the meeting held on Monday, April 6, 2020, as submitted.
- TREASURER’S REPORT AND MONTHLY BILLS
A motion was made by Supervisor Matuszak, seconded by Supervisor Monahan, and carried by a vote of 4-0, to approve the Treasurer’s Report and the Monthly Bills for the month of April 2020, as submitted.

All business having been discussed, a motion was made by Chairman McKinstry, seconded by Supervisor Monahan, and carried by a vote of 4-0 to adjourn the meeting at 8:45 p.m.
