Meeting of the Board – September 8, 2014
Chairman Cuyler H. Walker called the public meeting to order at 7:02 p.m.in the Township Building, by leading the group in the Pledge of Allegiance. Board members Richard P.S. Hannum, Eddie G. Caudill, Robert F. Weer and John Sarro were also present, as was Solicitor Fronefield Crawford, Jr., and Engineer James W. Hatfield.
Public Comment Period.
Joe Freney of Traditions requested more speed enforcement and additional stop signs on Street Road. He said that the recent traffic accidents argued for a reduced speed limit. He was told that Rt. 926 (Street Road) is a PA DOT owned and maintained road, although the Township police department can monitor the speed of vehicles.
Jack Greenwood of Unionville asked about the Certificate of Occupancy for the Fenza property and about the status of the buried fuel tanks. The C of O was issued on August 8, 2014, and the tanks closure was verified by a DEP-licensed firm. Soil tests indicated no leakage.
Ordinance 2014-02 – Parameters Ordinance for Bond Refinance. Dan O’Brien, Esq. of Baird and Tim O’Neill, Esq. of Lamb McErlane, both spoke about the opportunity for refunding the Township’s 2006 and 2009 Bonds at a lower interest rate.The Township recently received an upgrade from Standard and Poor’s, rating East Marlborough AA+. The savings over the life of the two bond issues, through 2032, would exceed one million dollars for the sewer users, in the form of lower annual bond payments. The Parameter’s Ordinance would authorize the debt, setting parameters for amount and re-payment schedule, as well as authorize payment to the bond underwriter. By unanimous vote (5-0), the Ordinance was approved as drafted.
Resolution 2014-10- Compliance Resolution. By unanimous vote (5-0), the Supervisors approved the resolution which requires continuing disclosure of Township Financial condition, including publishing the annual audit and budget.
Minutes of August 4, 2014. Mr. Weer suggested that the word “walkway” be changed to sidewalk, in reference to discussion about the Unionville Community Park. Mr. Sarro noted that the Building Code Appeals Board need not include a plan examiner among the Appeals Board members, as was represented by a resident at the August meeting. By unanimous vote (5-0), the minutes were approved, as corrected.

Stonecrafters and Zeke Associates – Conditional Use Order.The Supervisors unanimously approved (4-0, with Mr. Weer abstaining, because he was not present at the hearing) the 7 items in the Order:
1- Requiring that the use of the property be substantially in accordance with testimony and exhibits,
2- Noting that there would be no expansion of either the building or the parking area, although interior renovations are permitted. Additionally, the Order provided that the existing paved parking area be line painted for individual spaces,
3- Providing that the southern border be examined by Township consultants to determine whether additional landscape screening is needed,
4- Requiring that Applicant make contribution to emergency services in the amount of $1400, due at the time of issuance of Certificate of Occupancy,
5- Requiring that the use of property be in accordance with physical standards as set forth in Section 1811 of the Township Zoning Ordinance,
6- Requiring reimbursement of all costs for Township consultants, in excess of application fee for the C. U. Application.
7- Permitting modifications to the Order without need to re-open the hearing.
In a second unanimous vote (4-0, with Mr. Weer abstaining), the Board approved the Order, in its entirety.
Wiggins Insurance Agency – Route One – Conditional Use Order. The Supervisors unanimously approved (4-0, with Mr. Weer abstaining, because he was not present at the hearing) the following thirteen items in the Order:
1- Usage of property shall be substantially in accordance with testimony and exhibits,
2- Applicant shall not expand the building, although interior renovations are permitted.
3- Applicant shall provide handicap parking space, as indicated on Exhibit A-5 (b).
4- Applicant shall provide signage preventing vehicles from utilizing the eastern loop for egress onto Baltimore Pike. The eastern loop shall be used only for ingress.
5- Applicant shall remove two parking spaces closest to Baltimore Pike and then restripe the driveway ingress/egress lanes to provide safe access for both buildings.
6- Applicant shall replace the existing pylon sign, pursuant to a sign permit; the new sign must be in place prior to the occupancy of the insurance services office.
7- Applicant shall maintain a minimum of 14 parking spaces on the site.

8- At such time that Baltimore Pike is widened, the applicant shall reconfigure the ingress and egress drives in order to provide substantially the same size turning radium as now exists.
9- Applicant shall make a contribution to emergency services in the amount of $400, due at the time of Certificate of Occupancy.
10- Use of the property shall conform to all representations made during the Conditional Use hearing, as well as with all applicable laws, ordinances, and regulations.
11- Applicant shall confer with Township Manager regarding desirability for enhanced landscaping along the eastern border of the property.
12- Applicant shall reimburse the Township for all expenditures which exceed the cost of the application fee.
13- The Supervisors reserve the right to make modifications to the conditions without re-opening the conditional use hearing.
In a separate vote (4-0, with Mr. Weer abstaining), the Supervisors approved the entire Order.
Sketch Plan for Walnut Ridge. Alyson Zarro, Esq., Ken Hoffman, P.E., and Ken Gough from Orleans Homes were all present to discuss the proposal to increase the number of units in the Walnut Ridge townhouse development, if the developer decides to purchase 2+ acres to the south. The additional land would: a) provide for a better layout of the houses, b) permit 13 additional units, c) allow for an entrance road opposite Gale Lane, and d) argue for a four-way stop at Gale Lane and Walnut Roads. The board took no action on the sketch plan.
Unionville Community Park – Township Engineer, Jim Hatfield said that Bulldog Construction, the site contractor, wants to close out the contract and is not interested in additional change orders to the contract. Therefore, the proposal for: a) additional concrete sidewalk from W. Doe Run Road alongside Po-Mar-Lin Fire Company to the park, b) additional fencing both along that sidewalk as well as on the east and west sides of the Dauphin outparcel, and finally c) extension of the trail about 300 feet from the second bridge crossing the wetlands, would all be extra bid items. By unanimous vote (5-0), the Supervisors authorized the preparation and bidding for the additional work.
Stream Bank Erosion on the Ross Property – Street Road– Township Engineer, Jim Hatfield said that the Ross family had noted the increased erosion on the stream bank on the west side

of the family house on Street Road. Mr. Hatfield did not have an opportunity to complete his research on the matter by the time of the meeting; no action was taken.
Zoning Ordinance Amendments.The review letter from the Chester County Planning Commission noted several typographical errors in the text. Additionally CC Planning suggested that the section providing for lot averaging be clarified. After revisions, the Ordinance will be re-submitted to Chester County Planning.
Replacement Police Trailer – Location. Mr. Weer moved to locate the replacement trailer at the Unionville Park site. Mr. Walker seconded the motion. Motion did not pass by a vote of 2-3, with Messrs. Weer and Walker voting in favor and Messrs. Caudill, Hannum, and Sarro voting against.
Mr. Caudill then moved that the replacement trailer be located at the Township site; Mr. Sarro seconded the motion. The motion was approved by a vote of 3-2, with Messrs. Caudill, Sarro, and Hannum voting in favor, and Messrs. Walker and Weer voting against.
Resolution 2014-11 – PennDOT Winter Maintenance Agreement. By unanimous vote (5-0), the Supervisors approved the resolution providing for Township winter maintenance of specified State-owned and maintained roads within East Marlborough for 5 years, until the winter season of 2018-19, for an annual reimbursement from PennDOT of $16,281.67.
Longwood Gardens Request for Full Stop Sign at Longwood and Conservatory Roads.Penny Persons from Longwood requested that the sign attached to the stop sign on westbound Longwood Road at Conservatory Road, which permits right turns without stopping, be removed. Longwood officials felt that it would be better to stop all vehicles before turning onto Conservatory Road, because there will be more truck traffic on Conservatory Road for the next two years during the re-construction of the fountains. The Supervisors decided to keep the sign in place and permit the right-turning vehicles to keep moving.
Minimum Municipal Pension Obligation for 2015. The calculation of the Township Pension obligation for 2015 is: Police Plan – $18,413 and for Non-Uniformed Plan – $49,014.
Certificates of Appropriateness.The following requests were referred by the Historic and Architectural Review Board:

Dauphin – Town’s End Farm – springhouse was knocked from foundation by a falling tree. The Supervisors voted unanimously (5-0), to permit the demolition of the springhouse.
Schuhl – 1647 W. Doe Run Road – request for a shed. HARB recommended approval; the supervisors voted unanimously (5-0) to approve.
Blomer – 1667 W. Doe Run Road – Proposal to replace the front porch; the Supervisors voted unanimously (5-0), to approve the Certificate of Appropriateness.
Bills. By unanimous vote with each supervisor abstaining on a single vote with a perceived conflict of interest, the attached list of invoices was approved for payment, with the following totals:

Treasurer’s Report. By unanimous vote (5-0), the Supervisors accepted the attached report, as prepared.
The meeting was adjourned at 9:37 p.m., at which point the Supervisors went into executive session with the Solicitor to discuss a pending land purchase.
