BOARD OF SUPERVISORS
Meeting of the Board – July 6, 2015
Chairman Walker called the public meeting to order at 7 p.m. at the Township Building by leading the group in the Pledge of Allegiance. Board members Richard P.S. Hannum, Eddie G. Caudill, Robert F. Weer, and John Sarro were also present, as were Solicitor Fronefield Crawford, Jr. and Engineer James Hatfield.
Public Comment Period.
Shelley Mincer said she was having difficulty finding the Township minutes on the website.
Minutes of June 1, 2015. By unanimous vote (5-0), the Supervisors approved the minutes, as prepared.
Union Walk (formerly Walnut Ridge) – Scott Emerson represented the developer. Engineer Jim Hatfield had recommended that public improvements escrow account in the amount of $2,641,934 be approved and established for Phase I of the 61-unit plan; twenty-one uni Mr. Emerson said that he would convey the Supervisors’ displeasure with the proposed subdivision name to the owners.
Whitewing Farm. Ron Agulnick, Esq. represented the owners Lance and Sandy Shortt, who were all present. Mr. Agulnick presented a letter requesting a compromise settlement, in advance of a ruling by the Court:
Indoor Receptions – limited to 60 guests
Outdoor Receptions – limited to 14 per calendar year, with no more than 150 persons in attendance.
Chairman Walker said that the Township would circulate the proposal among interested residents and request response/input from local neighbors. No additional action was taken.
Timber Harvesting on the Kreutzel Property. Levi Stoltzfus had applied for a permit to harvest timber on the Kreutzel property, accessing onto Blackshire Drive. Mr. Stoltzfus said that the work would last about two weeks and would begin about 7:20 each weekday morning and

conclude by approximately 4 p.m. The trucks would travel out on Blackshire Road, onto Route 82, and then to the Route One by-pass.
There was one oak tree, approximately 40 inches in diameter, which cannot be removed without approval from the Board of Supervisors. Jim Hatfield and Eddie Caudill agreed to meet at the site to examine the 40-inch tree prior to giving approval and to video the area to create a record of existing conditions. By unanimous vote (5-0), the Supervisors approved the permit for timbering, except for the 40-inch tree, and with the condition that an escrow of $5,000 be established to guarantee repair of any damages.
Upland Country Day School. The final Land Development Plan was represented by Ken Hoffman, P.E. of Gilmore Associates, Paul Sgroi of Bernardon Associates, and Tom Reid, Headmaster of Upland. The minor plan proposes an addition to the Kleberg Building. By unanimous vote (5-0), the Board approved the plan.
Windov’r WayHOA Documents. Verne Blodgett had submitted revised documents and by-laws, making minor changes to the regulations. Frone Crawford reviewed the revisions and saw nothing that would impact the Township. By unanimous vote (5-0), the Supervisors approved the revisions and requested that a date-stamped copy be submitted to the Township, after recordation in the Recorder of Deeds office.
Unionville Crosswalks.The Township had received a proposal from Traffic Planning and Design for a study and design of two crosswalks on Route 82; at Unionville High School and at the URA fields at the western end of Unionville. Supervisor Hannum will discuss the details of the proposal with TP&D and then set up a meeting of safety committee members to discuss options and plans.
Line Painting.Alpha Space Control was the low bidder for the Kennett Area Regional Cooperative municipal bid. Their contract for East Marlborough for 2015 was $32,483.40. By unanimous vote (5-0), the Supervisors approved the bid and signed the contract.

Bills. By unanimous vote (5-0), with each supervisor abstaining on a single invoice with a perceived conflict of interest, the Board approved the attached list of invoices, with the following totals:
General Fund $150,217.70
Sewer Fund $ 49,034.93
Development Fund $ 1,485.75
State Fund $ 33,200.00
Payroll $ 54,823.81
Treasurer’s Report – By unanimous vote (5-0), the supervisors accepted the attached report, as prepared.
The public meeting was adjourned at 9:47, at which point the supervisors went into executive session with the solicitor to discuss two pending legal matters.
