Meeting of the Board – March 2, 2015
Chairman Cuyler H. Walker called the public meeting at 7 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Board members Richard P.S. Hannum, Robert F. Weer, and John Sarro were also present, as was Solicitor Fronefield Crawford, Jr.
Public Comment Period.
Shelly Mincer, anadvocate for Po-Mar-Lin, spoke about plans for an August 22, 2015 “Thank You” Party for Po-Mar-Lin, scheduled to be held at Cheslen Preserve.
Benjamin Hickinbotham and Michael Liebman, residents of Belrose, asked about the Township engineer’s response to the Hydro Study that the HOA had a consultant perform. They expressed concern that all of the issues be resolved by the developer prior to the expiration of the 18-month guarantee of the work. Township Engineer, Jim Hatfield was not in attendance; the item will be placed on the April meeting agenda.
Supervisor Walker announced that the past Chair of the Township Planning Commission, Mark Benzel, has resigned because he no longer lives in the Township. The Supervisors are very grateful and appreciative of his service. The Planning Commission elected Christine Kimmel, Esq. to chair the Commission and Charles Streitwieser as vice-chair.
Minutes of February 2, 2015. By unanimous vote (4-0), the minutes were approved, as prepared.
Report of the Library Board.Librarian Donna Murray summarized the written submission discussing the accomplishments and activities at the Library for the past year. She discussed plans for the future, which include building a new facility at the Waywood Road site, hopefully within five years. The Supervisors recognized the service of Bill Landmesser, who has served as East Marlborough representative on the Library Board for twenty years; the Township and the Library Board are most appreciative of Mr. Landmesser’s service.
Kennett Run Charities.Michael Elling, director of the Kennett Run, requested permission to close several roads in East Marlborough for limited times on May 16, 2015. The run will use the same route as previous years, traveling north on Route 82, into the Cedarcroft Subdivision, and then east on East Locust Lane to Walnut Road and finishing at Anson B. Nixon Park. By unanimous vote (4-0), the Supervisors authorized the temporary road closures, subject to more information about the details of the event as well as a valid certificate of insurance, naming East Marlborough as an additional insured.
Conditional Use Applications. CJK Investors – Application for 180 townhouses to be located on 38+ acres, accessing onto Schoolhouse Road. The Supervisors set 7p.m. on Monday, April 13, 2015 as the date for the opening hearing on the application.

Stephens Excavating- Application for an Excavating business to be located on a three-acre site in the Limited Industrial District, off Schoolhouse Road. The Hearing has been set for Monday, April 20, 2015 at 7 p.m.
Phil Petroll Landscaping – Application for a landscaping business to be located on Gale Lane, in the Limited Industrial District; the hearing has been set for Monday, April 20, 2015 immediately following the previous hearing for Stephens Excavating.
Longwood Gardens Request for Temporary Alteration of Traffic on Greenwood Rd. Greg Papiernick, Director of Security at the Gardens, requested permission to alter the traffic pattern on the northern leg of Greenwood Road, for certain high-traffic weekends in the spring, to facilitate travel to off-site parking. By unanimous vote (4-0), the Supervisors approved the request.
Mary Ann Rossi, Esq. represented the Gardens in the presentation of the plan for a new electric substation, proposed to be built to accommodate the increased electrical needs of the Garden displays.
Also representing the Gardens and explaining the plan were Erin McCloskey, P.E. of Urban Engineers, and Mike Petka of Bancroft Construction. The Board will review the land development proposal at the April 6, 2015 Board meeting, after receiving comments from County Planning.
Walmart – Request for Outdoor Sales Area for Nursery and Garden products. Crista Briceland of Dan Schantz Farm & Greenhouses, requested approval to cordon off approximately 12,420 square feet of parking area for outdoor display and sales of nursery products from April 15, 2015 through July 15, 2015. The Board directed Solicitor Frone Crawford to review the Conditional Use Order to see whether the request conflicts with the Conditional Use Order. By a vote of 2-2, with Supervisors Walker and Hannum voting in favor, and Supervisors Sarro and Weer voting against, the request was not approved. The applicant was advised that she could make the request at the April meeting, when it is expected that there will be five Board members present.
Unionville Park – Phase II Design. VanDemark & Lynch together with Glackin Thomas Panzak had submitted a written proposal for the design and preparation of bid documents for Phase II of the Park; the total cost of the design is expected to be $145,900. By unanimous vote, the Board approved the proposal for both consultants and authorized commencement of the design work.
Unionville Lawn Care. The Township had received a proposal for winter maintenance of the brick walkway in Unionville as well as the new walking paths in the Unionville Park, based on a per-event cost.
By unanimous vote (4-0), the Board accepted the proposal of Don and Mike Wells, Unionville Lawn Care. The proposal is for winter maintenance through 2017.
Mowing Tractor for Road Department.Roadmaster Dennis Mellinger had researched options for replacing the Township’s current mowing tractor; the State-purchase price is $107,354.98. By unanimous vote (4-0), the purchase was approved.

Ordinance Hearings.The supervisors are considering two ordinances and have scheduled the public hearings for 6:45 p.m. on April 6, 2015, immediately prior to the scheduled April Board meeting. The two hearings are:
1) Ordinance 2015-02 – Zoning Ordinance title correction to reflect amendments through January 2015, and
2) Ordinance 2015-03 – Authorizing participation in Pennsylvania Townships Health Insurance Cooperative Trust, which provides Life, Dental, and Disability insurance for township employees.
Bills. By unanimous vote (4-0), with each supervisor abstaining on a single item with a perceived conflict of interest, the Supervisors approved payment of the attached list of invoices, with the following totals:

Treasurer’s Report. By unanimous vote (4-0), the Supervisors accepted the attached report, as prepared.
The public meeting was adjourned at 8:32 p.m., at which point the Supervisors went into executive session to discuss a personnel matter, and a pending legal matter.
