Meeting of the Board – December 18, 2018
Vice Chairman Sarro called the meeting to order at 7:00 p.m. with the following people in attendance: Supervisors Lacy, McKinstry and Jameson. Solicitor Unruh, Engineer Hatfield as well as Planning Commission Chairman Walker and Township Manager Prysock.
Pledge of Alliance and Public Comment Period. No public comments.
Northridge Final Plan Signing. Mike Gavin representing the developer Doug White updated the Supervisors on the state of Mr. White’s financing for the project and requested that the Supervisors approve the release of the final plans without the financial security agreement and escrow in place. Mr. Gavin stated that he had been coordinating with Solicitor Unruh to have a prohibition agreement in place which would prohibit any construction activities on the property until the financial security agreement is finalized and the prohibition agreement is revoked.
Engineer Hatfield stated that the prohibition included language that requires disclosure of the prohibition agreement in the event that there is any transfer of lots or the entire property, until the financial security agreement is finalized and the escrow is posted.
The Township will handle getting the plans and the prohibition agreement recorded with the Recorder of Deeds office.
Supervisor Lacy asked if all of the outstanding conditions were addressed and Mr. Hatfield confirmed that they were addressed and he could verbally commit that the plans were complete.
The Supervisors voted 4-0 to accept the agreement prohibiting development until the financial security agreement and escrow have been posted in order to sign and release the plans for recording.
Longwood Village Shopping Center. Kevin Lahn represented the Longwood Village Shopping Center requested approval to change the light bulbs at the shopping center to LED and add lighting to the rear of the building where Ross Dress for Less will operate. Mr. Lahn stated he and the lighting design team had met with two Supervisors and Lisa Thomas from Glackin Thomas Panzak to review the plan and had made modifications based on Ms. Thomas’ input. The wallpack lights on the Ross store will dim to 25% after 8:00 p.m. to reduce the impact on the neighbors to the East. They also adjusted the color of the lighting.
Mr. Lahn requested approval for the lighting plan which would allow 4.3 foot-candles and make the lighting more uniform throughout the parking lot; the Supervisors voted 4-0 to approve the request.
The meeting adjourned at 7:30p.m. There was Conditional Use Hearing immediately following the meeting.

PUBLIC NOTICE
On Tuesday, December 18, 2018 at 7:00 PM at the East Marlborough Township Building, 721 Unionville Road, Kennett Square, PA 19348, the East Marlborough Township Board of Supervisors will conduct a public hearingto consider the application of 802 East Baltimore Pike, LLC for conditional use approval pursuant to Article IX, Sections 902.C 8, 16 and 21 of the East Marlborough Township Zoning Ordinance for a bank with drive-through (3,558 sq. ft.), a gasoline service station (5,189 sq. ft. Royal Farms facility), and a two-story medical office building (25,500 total sq. ft.) regarding the 6.4 acre property located at 802 East Baltimore Pike, East Marlborough Township, Chester County, Pennsylvania, and identified as Tax Parcel Nos. 61-6-97, 61-6-97.1, 61-6-98, 61-6-99, 62-4-107 and 62-4-106.3 (Property). The applicant is the equitable owner of the property which is located in the Multiple Use (MU) District of the Township.
