Meeting of the Board – December 7, 2015
Chairman Cuyler H. Walker called the public meeting to order at 6:54 p.m. in the Township Building, immediately following the public hearing on Ordinance 2015-05. Mr. Walker led the group in the Pledge of Allegiance. Board members Richard PS Hannum, Eddie G. Caudill, Robert F. Weer, and John Sarro were also present, as were Solicitor Fronefield Crawford, Jr., and Engineer James A. Hatfield.
Public Comment Period.
Shipley Allinson, a resident on Doe Run Road, thanked the Supervisors for: a) their support of the proposed ordinance which will limit truck traffic on E. Doe Run Road, and b) facilities installed at the Unionville Community Park. Mr. Allinson did note that the fence rail on one of the wetlands-crossing bridges needs repair and that many of the trees have been planted too deep. Because he is a trained and certified arborist, he offered to assist and advise with park landscaping.
Jackie Powell, a resident on Wollaston Road in Unionville, asked about the future plans for the former fire company buildings, purchased by the Township.
Vice-Chair, Richard Hannum, presented an historic map of East Marlborough to Mr. Walker, in recognition of and appreciation for his dedicated service to the Township.
Minutes of November 9, 2015. By unanimous vote (5-0), the minutes were approved, as prepared.
Ordinance 2015-05 – Limiting Trucks on East Doe Run Road from Route 926 (Street Road) to Oak Tree Road.The Ordinance would restrict through truck traffic, permitting only emergency vehicles, school buses, and local deliveries. All intersections must be posted, informing truckers of the new restrictions. By unanimous vote (5-0), the Supervisors adopted the Ordinance, which will take effect within five days.
Unionville “Run for Our Sons.”Paul Johnson, organizer of the annual run which benefits those afflicted with Muscular Dystrophy, requested permission for temporary closure of Route 82 on Saturday, April 16, 2016 from approximately 8:55 until 10 a.m., for the annual fundraising run. By unanimous vote, (5-0), the Supervisors approved the closure.

Mushroom Cap 13.1.Organizers Sarah Nurry and Karen Dimascola spoke about their planned half marathon, proposed for several roads in East Marlborough, to be held in late 2016. They emphasized that their project is a non-profit organization, intended to showcase the beauty of this area of Chester County. The supervisors agreed that two supervisors would meet with the organizers to work on a route; no further action was taken.
Basilio Subdivision.Richard Basilio represented his father with the request to re-draw the property line between his father’s and his uncle’s property on a private lane accessing onto Orchard Avenue, on the north side of US Route One. The applicant requests waivers from six provisions of the Subdivision and Land Development Ordinance, including: shadow analysis, contour lines, landscape plan (preliminary and final), computations of adjusted lot area, and design information for on-lot sanitary. Jim Hatfield of VanDemark and Lynch has no objection to granting the waivers. In addition, a variance from Sections 1810 and 1903.B of the ZO would be needed to permit the reduction in lot size. By unanimous vote (5-0), the Supervisors approved the plan, including the itemized waivers and subject to a variance being obtained from the Township’s Zoning Hearing Board for the reduced lot size; the supervisors supported the variance request.
2016 Budgets.The final budgets (General Fund, State Fund, and Sewer Fund) are unchanged from the proposals submitted in November. The budgets project income and expenses in the General Fund of $2,250,990, in the State Fund: $412,230, and in the Sewer Fund: $1,011,080.
The following Resolutions were adopted by unanimous vote (5-0):
Resolution 2015-08 Establishing the Tax Levy for 2016 of 2.183 mills, with the following break-down: General Fund Expenses: 1.05 mills
Open Space .20 mills
Kennett Library .183 mills
Fire Protection .75 mills
Resolution 2015-09 – Establishing the Unionville Light Tax at 50 cents per lineal foot of measurable property frontage.
Resolution 2015-10 Establishing the Fire Hydrant tax at $26.73.
There will be no increase in Township taxes for 2016 ; all are the same as 2015.
Engineering Studies for Road Improvements.Traffic Planning and Design had submitted a proposal for $14,250 to perform a feasibility study for signalization of Routes One and 82, at the

northern leg of the overpass bridge. Kennett Township had approved funding 50% of the TP&D study, for $7,125. By unanimous vote (5-0), the Supervisors approved the remaining funding.
Remington & Vernick Engineers (Kennett Township) had proposed a study for a concept plan for an interchange with Walnut Road and Route One By-pass, for a fee of $3,254. By unanimous vote (5-0), the Supervisors agreed to fund 50% of the Remington and Vernick study, for $1,627.
Certificate of Appropriateness – By unanimous vote (5-0), the Supervisors accepted the recommendation of HARB and approved the proposed renovations to the chimney surround at 1669 W. Doe Run Road.
Library Board Appointment.By unanimous vote (5-0), the Supervisors appointed Tom Swett to represent East Marlborough on the Kennett Library Board. Mr. Swett had earlier served as Board president and has been an active supporter of the Library.
Resolution 2015-11 – Providing for No Winter Maintenance on Specified Township Roads. By unanimous vote (5-0), the resolution was adopted, with a correction to the wording of the signage.
Resolution 2015-12 – Acceptance of Sanitary Lines on Pennock Avenue.The resolution was adopted by unanimous vote (5-0).
Bills. By unanimous vote (5-0), with each supervisor abstaining on a single vote with a perceived conflict of interest, the Board approved the attached list of invoices, with the following totals:

Sewer Fund $12,890.39
Park Fund $12,049.08
State Fund $19,747.12

The public meeting was adjourned at 8:26, at which point the supervisors re-convened the Conditional Use Hearing for CJK, proposed developer of townhouses off Schoolhouse Road. The CJK hearing will re-convene on January 11, 2016 at 7 p.m.
Following the Conditional Use Hearing, the Supervisors met in executive session to discuss personnel matters.
