Meeting of the Board – November 7, 2016
Chairman Richard P.S. Hannum, Jr. called the public meeting to order at 7:07 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Board members John Sarro, Eddie G. Caudill, Robert F. Weer and Christine Kimmel were also present, as was Solicitor Frone Crawford, Engineer Jim Hatfield and Planning Commission Chairman Cuyler Walker.
Public Comment Period. No comments from the public
Minutes of October 3, 2016. The minutes were approved by a vote of 5-0.
Zoning Ordinance 2016-01. Mr. Hannum called for a vote on the amendments to the township zoning ordinance. The amendments were accepted by the Chester County Planning Commission and approved by the East Marlborough Township Planning Commission. The Supervisors approved the amendments unanimously by a 5-0 vote.
Resolution 2016-11. Mr. Hannum called for a vote on the resolution to add the Chase property located at 365 W. Street Road to the East Marlborough Township Agriculture Security Area. The Supervisors approved the resolution unanimously by a 5-0 vote.
Escrow Release – Bellefield #5. Engineer Jim Hatfieldrecommended the release of $64,842.12. The outstanding on-lot erosion and sediment control issues have been resolved and all of the outstanding landscape issues have been resolved according to the review letter from Glackin Thomas. The builder, Vintage Development represented by Vincent D’Annunzio, has acknowledged that they will provide a cash escrow at the time the building permit is issued for lot #7. The Supervisors voted to approve the release unanimously by a 5-0 vote.
Escrow Release – Glenelg Farm #16. Engineer Jim Hatfield recommended the release of $20,700.90 for work that was completed at Glenelg Farm. Bob Pearson requested the release and acknowledged that the builders will wait until spring to dedicate the roads to the township. The Supervisors voted to approve the release unanimously by a 5-0 vote.
Longwood Land Conditional Use Order – Ed Henry Car Wash. The Supervisors approved the Conditional Use Order with a vote of 4-0, with John Sarro abstaining, with the following conditions:
- The use and development of the property will be in accordance with the testimony except as specifically modified by the conditions set forth herein below:
- A maximum building footprint of $2,160 sq. ft.; and
- A maximum impervious coverage of 55%

- The site development plan to be submitted pursuant to the Township’s Subdivision and Land Development Ordinance shall be substantially as depicted on exhibits A-2, A-3, A-6, A-7and A-9.
- The applicant shall provide a total of not less than 14 parking spaces (2 inside and 12 outside) as depicted on Exhibit A-2.
- The applicant shall utilize rollaway trash canisters rather than a dumpster.
- The design of the car wash facility shall enable patrons to remain seated in their vehicle during all phases of the car wash, including the pay station, the “tunnel” car wash, rinse and drying procedures, and the exit from the building.
- The road access and internal circulation patterns shall be substantially in accordance with Exhibit A-2.
- The applicant shall provide landscaping and lighting in accordance with applicable ordinance standards, with the details thereof to be subject to further review by the Township Engineer and Township Landscaping and Lighting Consultant during land development and plan review stage.
- The appearance of the building shall be substantially in accordance with the styles and building materials predominating in the Baltimore Pike corridor of the Township. It is further stipulated that the prototype elevations submitted as Exhibit A-3 are deemed to meet these standards.
- All trash pick-up shall be between the hours of 7:30 a.m. and 9:00 p.m. Monday through Friday, and the hours of 8:00 a.m. and 6:00 p.m. on Saturdays. There shall be no trash pick-ups on Sundays.
- All trash and refuse operations shall be enclosed and operated to prevent emission of odors and spread of trash.
- The signage for the property shall be in conformity with applicable Ordinance requirements, unless the Applicant applies for and obtains variances from the Zoning Hearing Board.
- The Applicants Plan shall be reviewed by the Township Fire Marshal, and any necessary alterations to assure public safety (including interior circulation for emergency vehicles) shall be implemented prior to issuance of a building permit.
- The Applicant shall provide the buffer and landscaping areas substantially as depicted on Exhibit A-2.
- The Applicant shall construct, a the Applicant’s expense, a handicap accessible sidewalk along the property’s frontage with Schoolhouse Road, to tie in to the existing sidewalk along Onix Drive; provided, however, that the sidewalk area shall not be included within the calculation of maximum impervious coverage and may be within the front yard buffer area.
- The Applicant shall secure all non-municipal permits and approvals necessary for construction of the project, prior to the commencement of construction. In addition, Applicant shall submit to the Township’s consulting sewer engineer a list of the washing agents to be used, and shall abide by any requirements of the sewer engineer with respect thereto, in order to avoid any materials or agents that would be incompatible with or harmful to the Township’s sewer treatment processes.
- There will be no visible roof-top HVAC, plumbing or other equipment.
- At the time of closing the facility for the night, the Applicant shall place cones across the entrance to prevent unwarranted access.

- The exit area to the east of the car wash tunnel building will be of heated concrete in order to prevent icing in cold weather conditions.
- The Applicant shall pay for a total of 4 equivalent dwelling units as its tapping fee, concurrently with the application for a building permit. After one year of full usage, the tap fee shall be subject to adjustment (downward or upward, as the case may be) and any refund due to the Applicant will be returned, and additional payment will be made.
- There shall be no signage at the entrance from Baltimore Pike to the “right-in” driveway to the bank located immediately to the south of the Subject Property.
- The facility shall incorporate a system whereby a vehicle will not be discharged from the building itself until the previous car has exited past the stop bar to the east of the building exit.
- There shall be no detailing of vehicles on the site.
- The Applicant shall assume responsibility for a proportionate share of the Baltimore Pike (Route 1) Highway Improvement Program now underway (Phases 1, a portion of 2, 3, and 4 thereof having been completed, with the remainder of Phase 2 and Phase 5 thereof yet to be completed). Based upon the Applicant’s testing, the Applicant shall make a contribution to the Baltimore Pike Improvement Fund in the amount of $15,000. The funds shall be transferred to the Township at the time of issuance of a building permit. (Township shall have the right to utilize the funds for any of the phases of the Baltimore Pike Improvement Program yet to be constructed and/or to meet reimbursement obligations of the Township’s improvement partnership arrangements).
- The Applicant shall make a contribution for the acquisition or improvement of firefighting, rescue, ambulance, and other emergency services equipment, securing the safety of the proposed development, its employees and customers. The amount of this emergency service’s contribution shall be at the rate of $200 per 1000 square feet of total store space, being a total of $800 due at the time of the issuance of the building permit.
- The Applicant shall post performance guarantees for the installation of all improvements necessary for the protection of public health, safety and general welfare, including the stormwater management, landscaping and lighting facilities required hereunder.
- The Applicant shall comply with all requirements of the Township’s Subdivision and Land Development Ordinance and applicable portions of the Township’s Stormwater Management Ordinance, unless specific waivers are granted by the Board of Supervisors during the course of review of the land development plans.
- The Applicant’s project shall substantially conform with all representations made during the conditional use hearing, whether or not specifically referenced in this Order or in the Findings of Fact, and shall otherwise comply with all other applicable laws, ordinances and regulations. Without limiting the foregoing, the project shall conform with all physical performance requirements set forth in Section 1811 of the Township’s Zoning Ordinance.
- Within ten days of receipt of this Decision, the Applicant shall provide confirmation to the Township Solicitor that the Applicant has standing as a “landowner” as defined in the Pennsylvania Municipalities Planning Code.
- In the event that a handicapped/handicappable individual becomes employed at the car wash, the owner/employer shall specifically designate one of the two interior parking spaces as the “reserved” parking space for that particular employee.

- The Board of Supervisors reserves the right to make such modifications to the project as may be requested by the Applicant as the Board of Supervisors deems to be in the public interest, without the necessity of reopening the Conditional Use hearing, subject to the Board’s providing prior notice of the proposed modifications to parties of record in the hearing.
- The Applicant shall, within sixty (60) days of the date hereof, reimburse the Township for Township expenditures related to this Application, including all fees payable to Township consultants, the Township Solicitor, and costs of the court stenographer for appearances and transcripts.
Presentation of the 2017 Budget. Chairman Hannum announced that the 2017 Budget was prepared and would be discussed during the Executive Session following the meeting. Supervisor Bob Weer gave an overview of the budget which included an announcement that tax rates would remain the same in 2017. The budget reflects an increase in the real estate assessment to $699 million. The general fund budget is balanced with $2.4 million in receipts and $2.4 million in projected expenses. The Supervisors voted unanimously (5-0) to advertise the budget and make it available for public inspection.
Update of the Safety Committee. Supervisor John Sarro gave an update on the activities of township personnel to improve the safety conditions in the Village of Unionville and throughout the township which included speed enforcement and tree trimming. Traffic Planning and Design provided an estimate to install crosswalks at three locations: Route 82 at the URA Ballfields, Route 82 at Charles F. Patton Middle School and Route 82 at Unionville High School. The proposal exceeded the funds available so a request was made to separate the projects. The revised proposal was not received prior to the meeting.
Update on Unionville Park Phase II. At the suggestion of the Supervisors, Private Property signs will be placed at the property line between the park and Mr. Seller’s parcel. Additional dog waste receptacles as well as “Dogs must be on leashes” will be added at the Jackson Street and W. Doe Run entrances to the park. The park bills were approved by a unanimous (5-0) vote.
Bills. By unanimous vote (5-0) the Supervisors approved payment of invoices with the following totals:

Unionville Park $127,117.81
Treasurer’s Report. By unanimous vote (5-0), the attached Treasurer’s report was accepted as prepared.
The public meeting was adjourned at 9:15 p.m., at which point the Supervisors went into Executive Session to discuss the 2017 budget and a personnel matter.
