BOARD OF SUPERVISORS
Meeting of the Board – November 6, 2017
Prior to the public meeting the Supervisors met in Executive Session to review the budget requests presented by the Department Directors.
Chairman Richard Hannum, Jr. called the public meeting to order at 7:00 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Board members John Sarro, Eddie G. Caudill, Christine Kimmel and Robert F. Weerwere also present, as was Solicitor Frone Crawford, and Planning Commission Chairman Cuyler Walker.
Hearing on the Proposed Zoning Amendment. Planning Commission Chairman Cuyler Walker gave a brief overview of the proposed amendments which had been recommended by the Planning Commission and reviewed by Chester County Planning Commission. The majority of the changes are in the Limited Industrial Zone which if enacted would allow “Footprint” lots in that district. Other changes include prohibiting animal feed lots in the R-B district and changes to buffer requirements when different uses adjoin residential properties.
Public Comment Period. No comments.
Minutes of October 2 and 9, 2017. The minutes were approved by a vote of 5-0.
Zoning Ordinance 2017-04.The Supervisors voted 5-0 to approve the Ordinance.
Zoning Hearing Board Appointment. Chairman Hannum introduced three potential candidates for the open seat on the Zoning Hearing Board: Bruce Jamison, Jane Russell Laslo and Jack Greenwood. Mr. Hannum said all three were residents who have been involved with the committee and expressed an interest in serving on the Board. Mr. Hannum recommended that the Supervisors appoint Jane Russell Laslo to fill the remaining time of the late Steve Davidson’s term. Mr. Weer made a motion to appoint Mr. Jamison to the Board but the motion did not pass. Mr. Caudill made a motion to appoint Ms. Russell Laslo to the Board and the motion passed 4-1 with Mr. Weer opposing.
200 Gale Lane – MMC Auto represented by John Jaros. Mr. Jaros said his client, the Audi Dealership on Route 202, is interested in located a portion of their business at the current Metal Sales & Service facility on Gale Lane. The business would consist of housing new inventory, limited service on pre-owned vehicles and internet sales inventory. Mr. Jaros asked the Supervisors if the use would fall under the Conditional Use “Catch All” provision in the Zoning Ordinance since this use was different that

traditional auto sales. Mrs. Kimmel said Auto Sales are permitted in the MU and Commercial Highway districts so they would not meet the “Catch All” requirement.
Solicitor Crawford advised that East Marlborough Township has a process to request a Zoning Amendment which may allow for this use in the LI district.
CJK/Longwood Preserve Townhomes. John Jaros representing the developers updated the Supervisors on the effort to design a connector road to link their project with a project closer to Walnut Road. The engineers developed two plans, Option A which includes a stub road connection to the property being developed by Doug White and Option B which includes a stub road connection to the Avello property. Mr. Jaros said the engineers prefer Option B, the developers prefer Option B and the Planning Commission recommends Option B. It was acknowledged that there are issues to be resolved in order to make Option B a likely way to connect the neighborhoods on Schoolhouse and Walnut including the site distance at the driveway for the Avello property and the width of the easement for that driveway.
The Supervisors voted 4-1 with Mr. Caudill opposing to select Option B as the preferred location of the connector road.
Mr. Jaros asked the Board to weigh-in on another issue effecting the CJK development. The sight distance at the Boulevard entrance to CJK meet PennDot standards but does not meet East Marlborough’s standards. CJK is requesting that the Township approve the installation of a three-way stop sign on Schoolhouse Road where it would intersect with the CJK Boulevard. Mr. Jaros said the intersection would meet the warrants for a stop sign based on the cost to modify the profile of Schoolhouse Road, which would be roughly $500,000 and the installation of a pedestrian crossing. East Marlborough resident Dave Adamson raised an objection and asked the Township to insist on a turning lane and relocation of the entrance. After questions from the Supervisors regarding the sight-distance, Mr. Hannum said it was the Board’s preference for CJK to work with Mr. Adamson to relocated the Boulevard to the South to improve sight distance. Mr. Jaros said they would work on a solution and would come back before the Board at the December meeting.
Presentation of the Draft 2018 Budgets. Township Manager Prysock said the proposed budgets were balanced and would not require raising taxes in order to meet the needs of the residents. The total budget for the General Fund is $2,450,251.16. The State Fund Budget is 818,471.98. The Sewer Fund Budget is $1,179,440. The Park Fund is $499,955.

Road Contracts. Bid through the Southern Chester County Municipal Co-Op, the low bid to provide Road Salt to East Marlborough Township was awarded to Eastern Salt for a $53.840 per ton bid. The contract was presented for 1,800 tons of Road Salt for a total price of $96,840. The Supervisors approved the contract with a 5-0 vote.
Bills. By unanimous vote (5-0) the Supervisors approved payment of invoice with the following totals:
General Fund: $232,419.41
Payroll: $ 50,329.38
Sewer Fund: $ 30,221.82
State Fund: $ 16,383.64
Unionville Park: $ 4,478.79
Treasurer’s Report. By unanimous vote (5-0) the Treasurer’s Report was accepted as submitted.
The public meeting was adjourned at 9:10 p.m., at which point the Supervisors went into Executive Session to review personnel matters.
