BOARD OF SUPERVISORS
Meeting of the Board – October 3, 2016
Chairman Richard P.S. Hannum, Jr. called the public meeting to order at 7 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Board members John Sarro, Eddie G. Caudill, Robert F. Weer and Christine Kimmel were also present, as was Solicitor Frone Crawford, Engineer Jim Hatfield and Planning Commission Chairman Cuyler Walker.
Public Comment Period. East Marlborough resident Lewis Kinter spoke to raise a concern about the fencing at the Unionville Park. Mr. Kinter said the contractor at the park was installing a fence approximately 6” inches from his fence and he worried that it would become a gathering point for trash and weeds. Mr. Kinter asked the board to allow his fence to be the dividing line between his property and the park rather than installing a second fence. The board agreed to his request and will instruct the contractor to stop the fence at the property line between Mr. Kinter and Unionville Presbyterian Church.
Minutes of September 12, 2016. The minutes were approved by a vote of 5-0.
Appointment of Zoning Officer. Mr. Hannum announced that Charlie Shock and Scott Moran working under the umbrella of Accurate Building Inspections have been recommended to handle the zoning office role for East Marlborough Township. Accurate had presented the township with a price list for zoning fees that will remain in effect until December 31, 2016. The Supervisors will have the option to reappoint Accurate Building Inspections at the reorganization meeting in January 2017. The Supervisors voted unanimously (5-0) to appoint Accurate Building Inspectors as designated zoning officers for East Marlborough Township.
Appointment of East Marlborough Representative to the Kennett Library Board. Township Manager Prysock advised the Supervisors that Stanley Allen had resigned as the township representative to the Library Board. Library Board Chairman Tom Swett recommended that the Supervisors appointment long-term East Marlborough resident Margaret Egli to fill the remainder of Mr. Allen’s term. The Supervisors voted unanimously (5-0) to approving Mrs. Egli.
Run for Our Sons – Road Closure for 2017 race. Paul Johnson, represented the Run for Our Sons 5K race to request permission to close various roads near Charles F. Patton Middle School from 8:55 – 9:50 a.m. on April 22, 2017. The proposed closing would be from the roundabout at Route 82 and E. Doe Run Road to just past the high school. Police Chief Clarke had approved the plan and said two police officers will be on the road to direct traffic. Mr. Weer asked if the race had liability insurance and Mr. Johnson said they do under the National Honor Society who sponsors the race. Mr. Johnson will send a copy of

the insurance certificate to the township. With the condition that the Race organizers post No Parking Signs on Chapel Drive, the Supervisors voted unanimously (5-0) to allow for the road closing.
Bellefield – Escrow Release #4. Vince D’Nunzio was present to request and sign the release; by unanimous vote (5-0), the Supervisors approved the release of $127,387.88 as recommended by Township Engineer, Jim Hatfield.
Bellefield Dedication. Vince D’Nunzio was present to request that the Supervisors accept conditional dedication of Wyndham Hill Drive since the development of the Bellefield neighborhood has essentially been completed. Mr. Hatfield briefed the Supervisors on the outstanding items to be completed which include:
Infiltration basin A-1 and emergencies spillway modified as per design;
Receiving as built cross section plans from Mullin Engineer;
Placement of a “No Outlet” sign at the bottom of Wyndham Hill Drive;
Complete landscaping plantings;
Contribution of $1,552.73 to offset the maintenance on the road until 2017 when the Liquid Fuels tax revenue will be received and will include calculations for Wydham Hill Drive;
Letter of Credit for the developer guarantee.
Based on Mr. Hatfield’s suggestion, the Supervisors adopted Resolution 16-10 for the dedication of Wyndham Hill Drive by unanimous vote (5-0).
Walnut Walk Phase 1 – Escrow Release # 7. Scott Emerson was present to request and sign the release; based on Mr. Hatfield’s recommendation, the Supervisors voted unanimously (5-0), to approve the release of $33,412.50.
Walnut Walk Phase 2 – Final plans. Scott Emerson was present to request final plan approval and signatures for Phase 2 of Walnut Walk development. The Supervisors signed the final plans but will not release them until the final Land Development and Financial Security documents have been provided to the Township.
Marlboro Springs Subdivision – Plan Approval. Scott Emerson was present to request final preliminary approval for the subdivision plan for the Marlboro Springs project located between Marlboro and Marlboro Springs Road. Mr. Emerson said they are working with two of the neighbors to obtain a more clearly worded easement for the well that is located on one of the existing lots which will be retained by the current owners of the land.
Mr. Crawford raised the issue of what will be included in the financial security agreement since there will not be a street constructed. Mr. Hatfield said the agreement would cover Storm water Management, Erosion Control and Landscaping. The agreement calls for the escrow to be paid as lots are sold. A portion of the escrow will be allocated to the Ryan Family since they are retaining lot #2.

Mr. Caudill asked how many street trees are included in the plan and if the builder would agree to increase the number if they counted the Osage Orange trees that are to be removed as part of their landscape plan. Mr. Emerson agreed that they would plant additional trees if the Osage Orange trees were included in their calculations. Mr. Emerson also reported that the Right of Way for Marlboro Road would be 30’ and the Right of Way for Marlborough Springs will be 25’. Mr. Emerson said that trench drains will be installed at the driveways on Marlboro Springs Road to reduce the amount of run-off that would go onto the road. Mr. Crawford informed the developer that they will be assessed a $1,800 per lot impact fees for Open Space, Emergency Services and Traffic which is payable when the building permit is pulled. Mr. Walker said the Planning Commission had met with Bentley Homes on 9/29 and voted to approve the plan as it was presented. The Supervisors voted to grant Final Preliminary Approval to the plan to develop Marlboro Spring by a unanimous (5-0) vote.
Kennett Area Senior Center. Bob Whitlock represented the Kennett Area Senior Center and gave each Supervisor information about the Center and its funding needs. Mr. Whitlock asked the Board to consider putting a $4,000 contribution for the Center into the Township budget for 2017. Mr. Hannum asked roughly how much funding comes from other municipalities, Mr. Whitlock said that Kennett Township has given $3,000, Kennett Borough has contributed $4,000. Mr. Whitlock would like to attend the November Board of Supervisors meeting to make a formal request for funding.
Zoning Amendments. Mr. Walker said the Township is within the time frame for a November Hearing and recommends resubmitting the amended document to Chester County Planning. Mr. Walker said the purpose of the amendments was to clean up language in a few of the zoning districts including the Village, Limited Industrial and Commercial Zones as well as to clarify impervious coverage calculations. Mr. Weer raised the issue of 60’ front to front set-backs in the Multifamily District and specifically asked that the Supervisors seek input from Emergency Services personnel to help solve issues for set-backs. The Supervisors voted unanimously (5-0) to resubmit the Zoning Amendments to Chester County Planning and hold a public hearing to adopt the amendments on November 7th.
Salt Bids. The Southern Chester County Municipal Co-Op took bids for Salt for 2016-2017 and the winning bid was from Eastern Salt for $61.50 per ton. Township Road master Dennis Mellinger requested approval for a contract for 1900 tons of Salt for snow and ice removal. The Supervisors voted unanimously (5-0) to approve the contract totaling $116,850 for salt.
Bills. By unanimous vote (5-0) the Supervisors approved payment of invoices with the following totals:
General Fund $103,778.83
Payroll $ 61,022.90
Sewer Fund $ 24032.63
Unionville Park $102,326.95
Treasurer’s Report. By unanimous vote (5-0), the attached Treasurer’s report was accepted as prepared.

The public meeting was adjourned at 8:45 p.m., at which point the Supervisors went into Executive Session to discuss a personnel matter.
