Meeting of the Board – October 5, 2015
Chairman Cuyler H. Walker called the public meeting to order at 7 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Supervisors Richard P.S. Hannum, Eddie G. Caudill, and John Sarro were also present, as were Solicitor Fronefield Crawford, Jr., and Engineer James A. Hatfield. The public meeting convened immediately following an executive session with the Township Solicitor to discuss a pending legal matter.
Public Comment Period.There were no comments from the public.
Minutes of September 1, 2015. The minutes were accepted, as prepared, by a vote of 3-0, with Mr. Caudill abstaining because he was not at the meeting.
Po-Mar-Lin Audit. Jeff Groves, Po-Mar-Lin Trustee, handed copies of the 2014 Fire Company audit to the supervisors.
Regis Corporation – Walnut Walk –Insettlement of a challenge to one of the conditions in the Conditional Use Order, the Supervisors voted (4-0) to accept a $500 per unit contribution to the Township’s Open Space fund. None of the other conditions was challenged.
Wiggins – Conditional Use Order. Mr. Robert Wiggins asked the Supervisors to amend the provisions of the order to permit employee occupancy of the Farmers Insurance office building on Route One. Since this would constitute a second principal use of the facility, by a vote of 3-0, with Mr. Sarro abstaining, the Supervisors voted to amend the terms of the Order, provided that Mr. Wiggins seeks a variance from the Zoning Hearing Board for the second principal use.
Water Infiltration in Basement – 109 Ladbroke.Request for Township support and intervention to resolve the problem was presented by: Lana Edmondson, President of the Belrose HOA; Michael Liebman, Treasurer of HOA; Ross Segan, the property owner; and Cathy Proctor, representing the management company. The Township agreed to bring whatever pressure is possible to get the cooperation of Woodstone Homes to re-grade the land behind the unit to mitigate the water problem.

Longwood Gardens Request to Alter Traffic on Greenwood Road for times of heavy traffic during the Holiday Events. Greg Papiernik, Security Director at the Gardens spoke about the need to regulate the traffic to provide for easier access, especially if the on-site grounds are wet and traffic would need to park off site. By unanimous vote (4-0), the Supervisors approved the request.
Tough Mudder – Request for Road Closures on Green Valley Road. Representative Robyn Pigazzi said that the Sunday event, October 18, 2015, will cross Green Valley Road; she requested approval to close the road to vehicles between 7 a.m. and 4 p.m. on the 18th. By unanimous vote (4-0), the Supervisors approved the closure of Green Valley Road between 7 a.m. and 4 p.m. on Sunday, October 18, 2015; this is in addition to closure on Saturday, the 17th.
Damage to Doe Run Road.Roadmaster Mellinger has reported significant damage to Doe Run Road, as a result of heavily-loaded trucks using the road. The Supervisors agreed to get a proposal for an engineering study to determine possible causes of damage and whether restrictions can be placed on the road.
Zoning Ordinance Amendments.The Supervisors proposed some minor changes to the ordinance, including some definitions within the ESI District, as well as changes in the number of apartments and townhomes permitted in districts which permit the higher density. The Ordinance will be submitted to the County Planning Commission for review and scheduled for a public hearing on November 9, 2015 at 6:45 p.m., immediately prior to the regular November Board meeting.
Shredding and Electronics Recycling Event at Kennett Township.East Marlborough Township declined to participate in the multi-municipal event, scheduled for sometime this fall.
Emergency Services Consultant.By unanimous vote (4-0), the Supervisors authorized an additional $500 for consultant fee, making the total commitment from East Marlborough $5,500.
West Marlborough Township Police Fee. By unanimous vote (4-0), the Supervisors set the per hour fee for use of East Marlborough services at $80.

Bills.By unanimous vote, with each supervisor abstaining on a single vote with a perceived conflict of interest, the Board approved the attached list of invoices, with the following totals:

Treasurer’s Report.By unanimous vote (4-0), the Board accepted the attached report, as prepared.
The public meeting was adjourned at 8:43 p.m., at which point the Supervisors went into executive session to discuss a personnel matter.
