BOARD OF SUPERVISORS
Meeting of the Board – May 9, 2016
Chairman Richard P.S. Hannum, Jr. called the public meeting to order at 7 p.m. by leading the group in the Pledge of Allegiance. Board members John Sarro, Eddie G. Caudill, Robert F. Weer, and Christine Kimmel were also present, as was Solicitor Fronefield Crawford, Jr.
Public Comment Period. Louis Kinter of Wollaston Road said that the Chair of the Township Historic Commission had a conflict of interest and should not have participated in the vote on the demolition of 101 Poplar Tree Road. Mr. Kinter was told that it was actually HARB which had recommending jurisdiction and that the Supervisors voted unanimously to prohibit demolition of the historic house.
Minutes of April 4, 2016. Mr. Caudill pointed out that the price of diesel fuel was reflected incorrectly; it should have been listed as $2.506/gallon. Mr. Weer explained that his vote in opposition to the Police Agreement with West Marlborough was based on his view that if our Chief worked in West Marlborough, the rate of $80/hour would mean that East Marlborough taxpayers would be subsidizing West Marlborough; Mr. Weer objected to our Chief working in West Marlborough. With those two notations, the minutes were approved by unanimous vote (5-0).
Walnut Walk – Phase I, Escrow Release # 5 – Doug Knox represented the request. By unanimous vote (5-0), the Supervisors approved the release, as recommended by Jim Hatfield of VanDemark & Lynch in the amount of $312,494.90.
Request for Amendment to Signage Agreement – Kevin Lahn of R J Waters & Associates requested some modifications to the Agreement, first approved in July, 1992. He was seeking:
- An additional major tenant name on the Pylon sign, making the total number five, and
- Release from the limitation on colors to be used on the individual wall signs.
By unanimous vote (4-0, with Mr. Sarro abstaining), the Board approved the request. Mr. Lahn will have the amended Agreement prepared to be reviewed by Mr. Crawford.

Historic and Architectural Review Board. In a special meeting held on Thursday, May 5, 2016 at 5:30 p.m. at Kinloch Woodworking, the HARB recommended:
- That the pitched roof at 1721 West Doe Run Road be approved for the rear of the property to correct roof leakage – The Supervisors approved the recommendation unanimously (5-0)
- That the new oval sign proposed for Catherine’s Restaurant at 1701 W. Doe Run Road be approved; the Supervisors approved the recommendation by unanimous vote (4-0, with Mr. Sarro abstaining.)
Road Contracts.All bids had been received by the Kennett Area Co-operative. The low bidder for road surface treatment – oiling and chipping– was Asphalt Industries, for a contract price of $32,200. By unanimous vote (5-0), the contract was accepted. Roadmaster Mellinger plans to treat either the roads in Deer Creek Crossing, or the roads in Wiltshire.
By unanimous vote (5-0), the Board accepted the bid of Long’s Asphalt for re-paving Route 82 from Mill Road to the West Marlborough Township Line, for a cost of $127,159.50.
Bills.By unanimous vote (5-0), with each supervisors abstaining on a single vote with a perceived conflict of interest, the Board authorized payment of the attached lists of invoices, with the following totals:
General Fund $279,308.30
Sewer Fund $176,539.64
Payroll $ 53,792.29
Park Fund $ 3,375.73
Treasurer’s Report. By unanimous vote (5-0), the Supervisors accepted the attached report, as prepared.
The public meeting was adjourned at 7:35 p.m., at which point the Supervisors went into executive session with the Solicitor to discuss personnel matters.
