THE APPLICATION OFCLARK KENNETT REALTY PARTNERS, L.P. AND CAPS REALTY PARTNERS, L.P. The subject parcelis UPI No. 61-6-79 also known as 817 E. Baltimore Pike.The subject parcel is owned by the applicants. The subject parcel totals approximately 4.6 acres in area, and is located in the MU-Multiple Use Zoning District of the Township.The applicants seek a variance from §903.E.9(Area and Bulk Regulations) of the East Marlborough Zoning Ordinance to permit impervious coverage of 59.38% where 57.63% coverage exists and 55% coverage is permitted; an interpretation of §1823.B (Fence and Wall Regulations) regarding a retaining wall that exceeds four feet in height, or, alternatively, a variance from §1823.B.1 to permit a retaining wall in excess of four feet in height; a variance from§1812.C (Landscaping) to permit less than 10% of a proposed new parking area to be internally landscaped;and any other relief that may be necessary.
