Meeting of the Board – February 1, 2016
Chairman Richard P.S. Hannum called the regular February meeting to order at 7 p.m. in the Township Building by leading the group in the Pledge of Allegiance. Board members John Sarro, Eddie Caudill, Robert F. Weer, and Christine Kimmel were also present, as were Solicitor Frone Crawford, Jr. and Engineer Lisa Donlon.
Public Comment Period.
Shelly Mincer praised the work of the Township road crew for their storm clean-up work; she said they did a great job.
Minutes of January 4, 2016. Supervisor Weer noted that the reorganization section of the minutes failed to reflect his opposition vote to the position of Assistant Manager; the vote should have been 4-1, with Mr. Weer opposed. With that correction, the minutes were approved, by unanimous vote (5-0).
Walnut Walk – Escrow Release #3 – Doug Knox was present to request and sign the release; by unanimous vote (5-0), the Supervisors approved the release of $435,295, as recommended by Township Engineer, Jim Hatfield.
Kennett Run 2016. Chris Daney requested Board approval for closure of several roads in East Marlborough for race scheduled for Saturday, May 14, 2016. The roads which are subject to limited closure are: Route 82, Gatehouse Dr., Potter Drive, Taylor Lane, Dean Drive, East Locust Land, Longwood Road, and Walnut Road. Emergency medical services will be provided by both Longwood and Kennett Ambulances; East Marlborough Police Department will provide coverage. By unanimous vote (5-0), the Supervisors approved the road closures for the race, subject to working out all details with the East Marlborough Township Police Department.
Mushroom Cap Half Marathon. Sarah Nurry and Karen Dimascola requested road closures for the race, proposed for Saturday, October 15, 2016; the race is expected to last between 7 a.m. and 9:30 a.m., with roads being closed or restricted for limited times during that period. By a vote of 4-1, with Mr. Weer opposed, the Supervisors approved the limited closure of the following roads: Cedarcroft Rd., Mill Road, West Locust Lane, Wollaston Road, Poplar Tree Road, and North Mill Road; and subject to the race directors working out all of the details with

the East Marlborough Township Police Department. The race directors will request approvalfrom PennDOT for periodic closure of Route 926, while groups of runners are crossing the road at Mill Road.
Walmart Outdoor Sales of Garden Products. Lance Ransom, the manager of Walmart, represented the request for the summertime sale of garden products, to be staged in the northeastern parking area, adjacent to the east side of Walmart. The request is for the outdoor garden sales to last from April 1 until July 31, 2016. By supervisor vote of 3-2, with Messrs. Weer and Sarro opposed, the outdoor sales area was approved.
Pratt Property – Sketch Plan.Tim Jones, Richard and Kathy Pratt represented the plan, proposing 20 single-family dwellings on 32 acres on the east side of Route 82. The sketch plan proposes using the amended cluster zoning, which provides for dwelling units on smaller lots, with approximately 80% of the land in perpetual open space. Adjacent neighbor Jim Sinclair spoke in opposition to the plan, expressing concerns about auto lights spraying his dwelling as well as excessive Stormwater run-off onto his land.
No action was taken on the plan.
Walnut Walk.The preliminary plan was represented by Alyson Zarro, Esq., and Scott Emerson of Bentley Homes. They were requesting approval for Phase II, consisting of 53 dwelling units on the 16-acre site on Walnut Road. Sixty-one units had earlier been approved (twenty-one units are currently under construction in Phase I); this revision adds an additional twelve townhouse units and one single-family unit, resulting from the acquisition of a 2+-acre site, adjacent to the property on the south side.
Amendment to Conditional Use Order: By a vote of 4-1, with Mr. Caudill opposed, the Supervisors amended the Order of September 1, 2015 to provide: 1) a 16.9-foot building-to- parking setback (unit 65) and a 20.2 foot building-to-parking setback (Unit 71), and 2) with respect to buildings M and N, the Supervisors accepted that the “tract boundary” for purposes of the setback is inclusive of the single-family lot, and no modifications are necessary.
In a separate vote, the Supervisors approved the Preliminary Land Development for Phase II by a vote of 4-1, with Mr. Caudill opposed. The approval was subject to all of the conditions as listed in the VanDemark and Lynch letter of January 20, 2016.
In another separate vote (4-1, with Ms. Kimmel opposed), the Supervisors approved the plan as only Preliminary, pending input from the engineer and the Roadmaster on the wear conditions

on Walnut Road, suspected to be a result of the construction equipment from Walnut Walk work.
Resolution 2016-06.By unanimous vote (5-0), the Supervisors approved the Resolution for Sewage Facilities Planning for Phase II of Walnut Walk.
Bills.By unanimous vote, with each supervisor abstaining on a single vote with a perceived conflict of interest, the attached list of invoices was approved for payment, with the following totals:

State Fund $ 13,856.17
Treasurer’s Report. By unanimous vote (5-0), the attached report was accepted, as prepared.
The public meeting was adjourned at 8:49 p.m., at which point the supervisors went into executive session with counsel to discuss: a) a pending legal matter, and b) personnel matters.
