PLANNING COMMISSION

MINUTES OF JULY 6, 2004

Mark Benzel, chairperson, called the meeting to order at 7:37pm.

Present were Susan Beach, Nancy Olson, Richard Pratt and Chris Kimmel

 

I.          The minutes of the June 1, 2004 meeting were approved with one change:

            Page 3-“Chris Kimmel questioned whether hardship could be shown given that property is being used as zoned.”

            Motion: Chris Kimmel, second Susan Beach. Unanimous

 

Public Comment: none

 

II.         Wawa – Land Development Plan-US Route One – Skip Brian, Presenter

            Commissioners reviewed the seven page document Wawa, Inc. Preliminary Land          Development Plan from VanDemark & Lynch dated June 7, 2004, List of          Waivers Requested from East Marlborough Township Board of Supervisors and            the seven page document from Glackin Thomas Panzak, Landscape Architecture           dated June 3, 2004.

            Highlights of the presentation:

            A. Review of past history of the project before the township: a  Wawa and                                            adjacent five home land development

            B. Commissioner Olson was a party to the Conditional Use Hearing

            C. Developers complied with all the requests of the review letter

            D. Concerns of the Lighting Design Plans and delivery time restrictions addressed

            E. Developers will comply with all comments from Township Engineer, Jim                                Hatfield

            F. Commissioner Benzel referred to item 9 in the landscape report and suggested

                        the home site be moved back in order to preserve the 38” American                              Linden tree. Developers agreed to this proposal.

            G. Discussion of the size of the five home configuration and the limits the                                                homeowners would have to expanding because of set back restrictions.

            H. An audience member asked about the safe guards in place to protect the soil

                        and ground water from leakage of the fuel storage tanks. The presenter

                        explained that Wawa meets and exceeds PA requirements per this issue.

            I. Building architectural design reworked and plans now include canopy style fuel                       islands and brick to coordinate with existing buildings.

            J. Explanation of traffic flow patterns within the site and in/out along route one.

Commissioner Kimmel presented a motion to approve the 3 waivers in place subject to compliance with all the comments of the township review letter of Vandemark & Lynch, Inc. dated June 7, 2004, the Glackin Thomas Panzak report dated June 3, 2004 and to relocate the house on lot #1 to safeguard the American Linden tree. Commissioner Pratt noted his concern with the interpretations of Lisa Thomas, landscape architect.  Commissioner Beach seconded. Motion approved with a vote of 4 and 1 abstention, Commissioner Olson.

 

III. Maucher proposal for subdividing/selling land on SS of Route 1 –

             Presenters Hugo Maucher and Mr. Gouni

            A. Sketch plan presented with a Brewster Ice Cream Shop                               adjacent to the existing Hugo’s Restaurant. Proposal to relocate                                    the Maucher property line to include 25’ in the Brewster lot. Commissioner   Benzel suggested Maucher retain a portion of the footage to accommodate the   parking needs of Hugo’s.

            B. Discussion and clarification of the Brewster Ice Cream sketch plan

            C. Participants have met with township engineer, Jim Hatfield, concerning          landscaping requirements. The existing Hugo’s is grandfathered and      nonconforming.

            D.  Parking spaces and landscaping percentage explained and suggestions by

            the commissioners as to possible corrective steps to meet requirements.             Commissioner Beach pointed out that expanding a corner seating area to include 2            of the proposed parking spaces would bring the landscaping to an acceptable        percentage.

            E. 20’ side buffers need consideration.

            F. Impervious coverage at the limit

            G. Concluding summarized suggestions for landscaping areas.

Participants were thanked for their presentation.

 

IV. New Bolton Center-Land Development-Foundation for Fighting Blindness

            Presenter Jim Fritsch from Regester Associates. Informational presentation

            A. Sketch presented depicts leased land as it pertains to the surrounding property.

                         1.55 acres leased from New Bolton, University of PA

            B. Proposal to build an addition to the existing structure to accommodate the

                        expansion of the kennels and lab space. 5,055 sq. ft. addition

            C. Request for Land Development approval

            D. Plans have been submitted to township engineer, James Hatfield

            E. The question of whether the plot stands alone or is a portion of a larger

                        parcel could not be answered. Mr. Fritsch will research this question.

                        Requirements vary for a stand alone plot versus a portion of a larger parcel

            F. Requirements depend on the review of Mr. Hatfield and the tax parcel                                               delineation.

            G. Storm water management is a detention basin

The commissioners thanked Mr. Fritsch for his presentation.

 

After the agenda was completed commissioners expressed the following concerns:

Commissioner Pratt-delivery vehicles parking along route 82 behind Willowdale Center. Commissioner Benzel noted that the supervisors are aware of this situation and find no problem with this issue.

 

Walmart – Infiltration basins have standing water along with debris. No maintenance of the berm areas/mowing and trash removal. Landscaped beds within the traffic islands are not maintained.
