Meeting of the Board – March 3, 2008

Ordinance 08-01 – Temporary Outdoor Activities. Chairman Cuyler Walker called the public hearing to order at 7 p.m. to discuss the details and receive public input on the proposed ordinance regulating temporary outdoor activities. Mr. LaPara asked about the events for which this would apply. There were no other public comments. By unanimous vote (5-0), the Board adopted the Ordinance, as amended.

Public Meeting – 7:30 P.M. Board Chairman Cuyler H. Walker opened the meeting with a pledge to the United States Flag. Board members Richard E. Hicks, Eddie G. Caudill, Robert F. Weer, and Richard P.S. Hannum, Jr. were also present

Minutes of February 4, 2008. By unanimous vote (5-0), the minutes were approved, as prepared.

Public Comment Period.

Mr. Weer requested that the Board meet in executive session following the public meeting.

Mr. Hicks requested enforcement of the following:

Wawa – The conditional Use Order provided that the loudspeakers would not play music, but would be used only for communication; that Order is apparently being violated.

Hood’s BarBQ – The Unionville delicatessen apparently has signage that has not been approved and violates the zoning regulations.

Megill Homes – Has prohibited off-site signs in some locations in the Township

URS Corporation Contract for Engineering Services connected with the Route 82 South Sewer Project. Board members expressed concern about the ceilings on liability coverage, and requested. By unanimous vote (5-0), the Board authorized the Township Manager to sign the agreement, pending resolution of the question of Liability coverage.

Signage for Truck Restrictions on Cedarcroft and Bayard Roads. Supervisor Allan Falcoff and Chief Albert McCarthy, both of Kennett Township, presented the request for banning trucks that exceed thirty feet in length from traveling on both roads. They were requesting approval to post the signage in East Marlborough, since both roads begin in East Marlborough and continue into Kennett Township. The Supervisors had questions about what the impact of restricted truck traffic on those roads would be on adjacent

Somewhat parallel roads, specifically W. Locust in East Marlborough and Sickly Street in Kennett Borough. Roadmaster Eddie Caudill suggested that Kennett investigate the potential for widening Cedarcroft Road to accommodate the trucks. By unanimous vote, (5-0), the Board agreed to prepare a resolution for the over-size truck ban on Bayard Road, with the signage to be posted by Kennett Township. The Board was not in favor of restricting truck traffic on Cedarcroft because of the unknown impact on adjacent roads.

Custom Granite Proposal for location on Schoolhouse Road. No one was present to discuss the proposal; no action taken by the Board.

Bids: Sale of Generator. The high bid was received from Derrick String, offering $4015. By unanimous vote (5-0), the Board accepted the bid.

Demolition of Baltimore Pike Sewage Treatment Plant. The low bid was submitted by Four Seasons Landscaping of West Chester, for a price of $14,750. The Board voted unanimously (5-0) to accept the low bid, provided the bidder can provide the necessary insurance and bonding.

Fireworks at Longwood Gardens. By unanimous vote (5-0), the Board approved the following schedule of firework displays, with rain dates provided in parentheses:

May 25, 2008 (5/26, 5/27)

July 4, 2008 (7/6, 7/7)

July 19, 2008 (7/20, 7/21)

August 31, 2008 (9/1, 9/2)

September 6, 2008 (Sept. 7, 8)

November 28, 2008 (five minutes show at 7:50 p.m.)

December 31, 2008 ( 8-minute show at 9 p.m.)

Bills. By unanimous vote (5-0), with each supervisor abstaining on any single item with a perceived conflict, the Board approved the attached list of invoices, with the following totals:

General Fund $73,854.61

Sewer Fund $ 9,089.45

Payroll $56,337.45

Development $19,272.65

State Fund $11,314.78

Treasurer’s Report. Accepted as prepared, by unanimous vote (5-0).

The public meeting was adjourned at 8:14 p.m., at which point the Supervisors went into executive session to discuss personnel matters.
